Dividend ban in the spotlight
Labour launches a wave of inspections in companies to check whether the prohibition on distributing dividends during the ERTE COVIDs was not complied with.
The Labour Inspectorate has targeted fraud related to the exemption from social security contributions in companies that took part in the ERTE COVIDs.
Specifically, the inspectors are examining non-compliance with the prohibition on distributing dividends, asking the companies for minutes and accounts, not only for the year of the case, but also for previous and subsequent years.
María José Sánchez, Labour Law partner, analyses this situation in an interview with Pedro del Rosal published in El Confidencial on the chiaroscuro of the rule, such as the determination of the year to which the prohibition applies or the effects of non-compliance.
