Bringing trade unions onto company boards in a country of SMEs: Díaz's idea clashes with reality
The second vice-president and Minister of Labour, Yolanda Díaz, wants to materialise in this legislature an idea that has been on her mind for some years: democratising Spanish companies. With article 129 of the Constitution as a reference, the leader of Sumar agreed with the PSOE, in their coalition agreement, to promote "more effective participation" of workers in companies.
Alberto Novoa, partner in the Labour Law department of RocaJunyent, points out in this article in the newspaper El Español that "the current system is sufficiently and increasingly guaranteeing" and stresses that the representation of workers in companies is not deficient. Alberto Novoa understands that "the management bodies of the company are for business", while for the management of people there are "the worker committees and trade union organisations".
He also points out that "the rights to information, participation and negotiation that the labour law guarantees are extraordinarily broad and sufficient to ensure social participation in the running of the company".
