Lawyers doubt the advisability of judges deciding on compensation for unfair dismissal

Lawyers are wary of the changes in dismissal and warn that they could generate legal uncertainty.

Alberto Novoa, partner in Labour Law at RocaJunyent, recalls that the dismissal system "is set by law, according to salary and seniority, in a way that it is egalitarian".

"The salary and seniority criteria are objective and are sufficiently objective to set the quantum of a severance payment. The debate on whether the number of days is 33 or 45 is a question of social policy to be determined by politicians," said Novoa.
